3-year-old Josiah Brown was pronounced dead shortly after 10am on Sunday. He was pulled from the lake last Monday and had been in a critical condition ever since with doctors not expecting him to survive.

The boy suffered a fall of more than 6ft after being allegedly pushed by his aunt Victoria Moreno at Navy Pier. According to authorities the suspect then stood and watched as the child sank below the water.

The boy was found at the bottom of the lake by divers about half an hour later.

Initially, 34-year-old Moreno, told police that she was only a witness, before changing her story and saying she was holding the boy's shirt and let go because he "was acting up".

According to prosecutors, Moreno had taken the boy from the family home in Des Plaines in the morning while another aunt went to wake up her children and his grandmother went to get changed.

Moreno allegedly "stole the keys" to the family truck and "snuck out of the residence without anyone knowing that she had left."

The other aunt could no longer hear the boy talking "and became alarmed," prosecutors said. That was when she noticed Moreno and Josiah were gone, and the truck was missing.

Moreno was initially charged with attempted murder last week, as well as aggravated battery of a child under the age of 13 causing permanent disability. The Cook County state's attorney's office has not yet confirmed if the charges against Moreno would be upgraded following the death of Josiah.

Moreno is being held in Cook County jail after a judge ordered that she be held without bail.
